Committee Removes Several Essential Provisions of Water Bill

Yesterday, Monday, March 3rd, the House Finance Committee removed the requirement for individual NPDES permits in S.B. 373, the Water Protection Bill.
 Had an individual permit been issued for Freedom Industries, it would have received an extra level of scrutiny and analysis because:
  • it would have been put out for public notice and comment;
  • the WVDEP could have included site-specific requirements.
Individual permits for facilities like Freedom Industries are critical for the protection of our water.

Contact House Speaker Delegate Tim Miley now and tell him to amend individual NPDES permits back into S.B. 373!

While the individual permit requirement is essential - there are other critical deficiencies in the Finance Committee bill, these include:
  • Removal of the commission to study Chemical Safety Board recommendations
  • Removal of the medical monitoring requirement
  • Two new exemptions to definition of Above ground Storage Tanks (ASTs)
  • ASTs no longer have to annually provide key information to downstream public water systems; instead, the frequency will be up to DEP
  • Coal facilities are exempt from DEP fees related to compiling inventory of potential significant contaminant sources
  • Early warning chemical detection system removed for WVAW system in Charleston

Tell House Speaker Delegate Tim Miley to stop weakening S.B. 373!
